As YumChat.AI cannot control all content posted by users and/or third parties on the Service, you agree to use the Service at your own risk. Although regular backups of Content are performed, YumChat.AI does not guarantee there will be no loss or corruption of data. Corrupt or invalid backup points may be caused by, without limitation, Content that is corrupted prior to being backed up or that changes during the time a backup is performed. YumChat.AI will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of Content. But You acknowledge that YumChat.AI has no liability related to the integrity of Content or the failure to successfully restore Content to a usable state. You agree to maintain a complete and accurate copy of any Content in a location independent of the Service.

Website or Services Content, Software and Trademarks The Service and its original content (excluding Content provided by You or other users), features and functionality are and will remain the exclusive property of YumChat.AI and its licensors. The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of YumChat.AI.

By using YumChat.AI, you acknowledge that any automated AI character you create or upload is owned by you. You also own all rights to any derivative works created from the Character, including any text, images, or videos generated by the Character at your direction, either directly or indirectly. You hereby grant YumChat.AI and other YumChat.AI users who elicit Generations from your Character a nonexclusive, worldwide, royalty-free, fully paid up, transferable, sublicensable, perpetual, and irrevocable license to copy, display, upload, perform, distribute, store, modify, and use the Character and its related Generations for any purpose in any form, medium, or technology known or developed in the future, to the maximum extent permissible under the law.

YumChat.AI shall not be held liable in any manner for any content or materials provided by third parties, including character bots created by third parties and any Generations resulting from such character bots. This includes, but is not limited to, any infringement of intellectual property rights, errors or omissions in such content, or any loss or damage incurred from the use of such content. You acknowledge that YumChat.AI does not pre-screen content, but YumChat.AI and its designers retain the right (though not the obligation) to refuse or remove any content available through the Website or Services at their sole discretion. You agree that it is your responsibility to evaluate and assume all risks associated with the use of any content, including relying on its accuracy, completeness, or usefulness.

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information about the Website or Services ("Submissions") that you provide to YumChat.AI are not confidential. You further acknowledge and agree that YumChat.AI has the right to use and distribute these Submissions without any restrictions for any purpose, without acknowledging or compensating you.

To the maximum extent permitted by applicable law, in no event shall YumChat.AI or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if YumChat.AI or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service.

Termination of your account or access to any component of the Services will not terminate YumChat.AI’s rights to your User Content. Further, you agree that YumChat.AI will not be liable to you or any third party for any termination of your access to the Services.

Disputes related to YumChat.AI shall be governed by the laws of the jurisdiction where AIchat is based.

You agree that any claim or legal action arising from the use of the Site or these Terms of Use must be filed within one year from the date the claim or cause of action arose; otherwise, it will be permanently barred, despite any contrary statutes or laws.

A printed version of this agreement and any notice provided electronically will be admissible in judicial or administrative proceedings relating to this agreement, following the same conditions as other business documents and records originally created and maintained in printed form.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
